Maggie Jewelry provides this Website subject to these Terms and Conditions. By visiting the Website, or using the services or applications on it, you accept these Terms and Conditions.

Access to the Website does not require registration. To place an order you will be asked to provide your details and accept these Terms before payment is completed.

Through the Website, Maggie Jewelry offers a curated selection of handcrafted jewellery - rings, necklaces, earrings, bracelets and pearl pieces - under the Maggie Jewelry brand. These Terms define the rights and obligations of Maggie Jewelry and of users, and they are the only Terms applicable to the use of the Website and to orders placed through it, replacing any other conditions unless agreed otherwise in writing.

Please read these Terms carefully before using the Website. By using any part of it you agree to be bound by them. If you do not agree with them, you may not use the Website or place an order.

Any new features or tools added to the store are also subject to these Terms. You can review the current version on this page at any time. We may update or replace any part of these Terms by posting the change here. Your continued use of the Website after a change is published counts as acceptance of it.

Our store is hosted on Shopify, which provides the e-commerce platform we use to sell to you.

Section 1 - Online store terms

By agreeing to these Terms you confirm that you are at least the age of majority where you live, or that you have the consent of a parent or guardian to use this Website.

You may not use our products for any illegal or unauthorised purpose, and you may not break any law in your jurisdiction while using our Service, including copyright law.

You must not transmit any worms, viruses or code of a destructive nature.

A breach of any of these Terms results in immediate termination of your access to our Services.

Section 2 - General conditions

We may refuse service to anyone, for any lawful reason, at any time.

You understand that your content, not including payment card information, may be transferred unencrypted, and may involve transmission over various networks and changes needed to fit the technical requirements of connecting networks or devices. Payment card information is always encrypted in transit.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service without our express written permission.

The headings in this agreement are for convenience only and do not affect these Terms.

Section 3 - Accuracy, completeness and timeliness of information

We are not responsible if information on this site is not accurate, complete or current. The material here is provided for general information and should not be used as the only basis for a decision. Any reliance on it is at your own risk.

This site may contain historical information, which is provided for reference and is not current. We may change the contents of the site at any time, and we have no obligation to update any information on it.

Section 5 - Products

Certain products may be available exclusively through the Website. They may be limited in quantity and are subject to return or exchange in line with our Return & Refund Policy.

Every piece in our collection is supplied free of charge. What you pay at checkout is a single shipping and handling fee of $24.95 per order. There is no product price, and no product value is charged to you.

Our products are made and dispatched by our fulfilment partner in Asia, and travel to you with an international courier and a local carrier. Delivery times are set out in our Shipping Policy. We currently ship to the United States only.

We have made every effort to display the colours and images of our products as accurately as possible. Each piece is handcrafted, so small variations in finish, stone and shade are normal and are not a fault. We cannot guarantee that your screen shows any colour accurately.

We may limit the sale of our products to any person, region or jurisdiction, and we may limit quantities. All product descriptions and prices may change at any time without notice. We may discontinue any product at any time. Any offer made on this site is void where prohibited.

All prices on this Website are in US dollars, and sales tax is added at checkout where it applies.

Section 6 - Orders, billing and account information

Your order is an offer to buy. Our automatic confirmation email means we have received it, not that we have accepted it. The contract between us is formed when we dispatch your order and send you a shipping confirmation.

If we cannot accept your order, for example because an item is no longer available, because of an obvious pricing or listing error, or because a fraud check flags it, we will tell you and refund anything you have paid in full.

We may refuse any order, and we may limit or cancel quantities bought per person, per household or per order. Those limits may include orders placed on the same account, with the same card, or to the same billing or shipping address. If we change or cancel an order, we will try to reach you on the email address or phone number given when the order was placed. We may limit or refuse orders that appear to be placed by dealers or resellers.

You agree to give current, complete and accurate purchase and account information for every order, and to keep it up to date so that we can complete your transaction and contact you if we need to.

Section 7 - Payment

Our website may permit you to purchase certain products through the website, including physical products offered by third-party suppliers and fulfilled on our behalf. You acknowledge and agree that all information you provide with regard to a purchase of our products, including, without limitation, credit card, PayPal, or other payment information, is accurate, current, and complete. You represent and warrant that you have the legal right to use the payment method you provide to us or our payment processor, including, without limitation, any credit card, PayPal, or other payment information you provide when completing a transaction.

We reserve the right, with or without prior notice and in our sole discretion, to (a) discontinue, modify, or limit the available quantity of any products and (b) refuse to allow any user to purchase any product or deliver such products to a user or a user-designated address.

When you purchase products from our store, you (a) agree to pay the shipping and handling fee set out on the applicable product page and at checkout, along with any applicable taxes in connection with your order (the "Full Purchase Amount"), and (b) authorize us or our third-party payment processors to charge your credit card, PayPal account, or other payment method for the Full Purchase Amount.

We may allow you to purchase products and designate them for delivery at a future date. In such instances, you acknowledge and agree that we may charge your credit card or other payment method for the Full Purchase Amount on the date of purchase, rather than on the actual date of shipment or delivery of the applicable products.

Unless otherwise noted, all currency references are in US dollars. All fees and charges are payable in accordance with the payment terms in effect at the time the fee or charge becomes payable.

Payment may be made by credit card, debit card, PayPal, or any other payment method we make available. Orders will not be processed until payment has been received in full. Any payment holds, authorization delays, or restrictions placed on your account by your bank, card issuer, PayPal, or other payment processor are solely your responsibility.

Section 8 - Optional tools

We may give you access to third party tools that we neither monitor nor control. You agree that those tools are provided as is and as available, and any use of them is at your own risk. Please make sure you are familiar with the terms on which the relevant provider supplies them.

Some content, products and services available through our Service may come from third parties. Third party links on this site may take you to websites that are not affiliated with us. We do not examine or evaluate their content and we are not responsible for it. Please read their policies before you engage with them, and direct any complaint about a third party product to that third party.

Section 10 - User comments, feedback and other submissions

If you send us creative ideas, suggestions, proposals or other material, whether we asked for it or not, you agree that we may edit, copy, publish, distribute, translate and otherwise use it in any medium, at any time, without restriction. We are under no obligation to keep it confidential, to pay for it, or to respond to it.

We may, but do not have to, monitor, edit or remove content that we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms.

You agree that your comments will not infringe anyone's rights, and will not contain unlawful, abusive or obscene material, or any virus or malware. You may not use a false email address, pretend to be someone else, or mislead us about the origin of a comment.

Section 11 - Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

Section 12 - Errors, inaccuracies and omissions

There may occasionally be information on our site that contains a typographical error, an inaccuracy or an omission relating to a product description, price, promotion, offer, shipping charge, transit time or availability. We may correct any such error and change or update the information, and we may cancel an order if any information was inaccurate, at any time and without notice, including after you have placed your order.

Section 13 - Prohibited uses

You may not use this site or its content: for any unlawful purpose; to ask others to take part in unlawful acts; to break any regulation, rule, law or local ordinance; to infringe our intellectual property or that of anyone else; to harass, abuse, insult, harm, defame, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; to submit false or misleading information; to upload or transmit viruses or malicious code; to collect or track the personal information of others; to spam, phish, pharm, pretext, spider, crawl or scrape; for any obscene or immoral purpose; or to interfere with or get around the security features of the Service.

Section 14 - Disclaimer of warranties and limitation of liability

We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error free. We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

Except where the law provides otherwise, the Service and all products delivered through it are provided as is and as available, without any representation, warranty or condition of any kind, express or implied.

In no case shall Joop Yellow Strategies LLC, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind arising from your use of the Service or any product bought through it. Where liability cannot lawfully be excluded, our liability is limited, at our option, to replacing the item, supplying an equivalent item, or refunding what you paid.

Some states do not allow the exclusion or limitation of liability for consequential or incidental damages, or the exclusion of implied warranties. In those states our liability is limited to the maximum extent permitted by law, and nothing in these Terms removes a right you have that cannot lawfully be removed.

Section 15 - Indemnification

You agree to indemnify and hold harmless Joop Yellow Strategies LLC and its officers, directors, agents, contractors, licensors, service providers, suppliers and employees from any claim or demand, including reasonable legal fees, made by a third party because of your breach of these Terms, or your breach of any law or of the rights of a third party.

Section 16 - Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it is still enforceable to the fullest extent permitted by law, and the unenforceable part is treated as removed without affecting the validity of the rest.

Section 17 - Termination

Obligations and liabilities incurred before the termination date survive the termination of this agreement.

These Terms apply until terminated by either you or us. You may terminate them at any time by telling us that you no longer wish to use our Services, or by stopping your use of the site.

If we judge that you have failed to comply with any part of these Terms, we may terminate this agreement at any time without notice.

Section 18 - Entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision.

These Terms, together with any policies posted by us on this site, are the entire agreement between you and us about your use of the Service.

Section 19 - Governing law

These Terms, and any separate agreement under which we provide Services to you, are governed by the laws of the State of Wyoming, United States, and you and we submit to the non-exclusive jurisdiction of the courts of that state. Nothing in this clause removes or limits any right you have under a consumer protection law of your own state that cannot be excluded by agreement.

Section 20 - Changes to these terms

You can review the current version of these Terms on this page at any time. We may update, change or replace any part of them by posting the change on our website. Your continued use of the Website after a change is published counts as acceptance of it.

Section 21 - Cancellations, returns and refunds

The full detail is in our Return & Refund Policy and our Cancellation Policy, and those policies are the ones that govern. In short:

Cancelling. You can cancel free of charge within 12 hours of placing your order, as long as it has not yet been packed, by emailing support@maggiejewelry.com with your order number and the word CANCEL in the subject line. A cancellation is final once we have confirmed it to you by email, and that confirmation carries a reference number. Once an order has been packed we can no longer stop it, and your cancellation becomes a return. A cancelled order is refunded in full within 5 business days of our confirmation.

Returning. You have 30 days from the delivery date to request a return, for any reason. The item must be unused and unworn, in its original condition, in its original packaging including the box and any protective pouch, and your order number must be included so we can match your parcel to you.

Before you post anything. Email support@maggiejewelry.com first. We reply within 24 hours on a business day with the return address and instructions. Items sent back without an approved return cannot be matched to an order.

What you get back. Every piece is supplied free of charge, so there is no product value to refund. What comes back is the $24.95 shipping and handling fee, in full, to the payment method you used. There is no restocking fee and no deduction. We process it within 10 business days of receiving and inspecting your return, and your bank or card issuer may take a further 3 to 10 business days to show it.

Return shipping. For a change of mind, the cost of returning the item to us is yours. We recommend a tracked service: we cannot refund a parcel we never receive, and without tracking there is no way to prove it was sent. Where the item is faulty, damaged or not what you ordered, you pay nothing and we cover the return cost.

When it is our fault. If an item arrives damaged, faulty or incorrect, email us within 14 days of delivery with your order number, a photo of the item and a photo of the outer packaging. We will send a replacement or refund your $24.95 in full, whichever you prefer, and we cover any return postage.

What cannot be returned. For hygiene reasons, pierced earrings cannot be returned once the sealed packaging has been opened, unless they are faulty. This does not affect your statutory rights.

Your rights

There is no federal cooling-off period for online purchases in the United States, so the 30 day window above is our own promise to you, and we treat it as binding. It sits on top of any right you have under the consumer protection law of your own state, never instead of it.

If you believe we have not met our obligations, email support@maggiejewelry.com first. You can also contact the Federal Trade Commission at reportfraud.ftc.gov, or the consumer protection office of your state attorney general.

Section 22 - Payment disputes and chargebacks

If something has gone wrong with your order, please email us at support@maggiejewelry.com before you raise a dispute with your bank or card provider. We answer within 24 hours, and almost everything we see is sorted out the same week.

We ask for a practical reason, not a legal one. A bank dispute takes 30 to 60 days, you have no say in it while it runs, and we are not allowed to refund you while one is open. Coming to us first is simply the faster route to your money or your replacement.

When a dispute is raised, we will submit the evidence we hold to your bank or card provider. That includes your order confirmation, the item you ordered, the payment record, the full tracking history, proof of delivery where the carrier provides it, and our email correspondence with you.

While a dispute is open we cannot issue a refund, pay out a return or send a replacement for the same order, because that would mean paying for it twice. Everything continues as soon as the dispute is closed.

Nothing in this section affects your right to dispute a payment with your bank. It sets out what we do when you use it.
